Prenuptial agreements
A Pre-Nuptial Agreement is a contract entered into by a couple prior to their marriage and determines who will get what in the event of their marriage breaking down. The agreement can be drafted with flexibility to meet each individual set of circumstances.
A Pre-Nuptial Agreement is not legally binding and in order to give the agreement the best chance of success should you seek to rely on it a number of factors should be complied with:
- Both parties should have independent legal advice.
- Both parties should fully and frankly disclose to one another their financial means.
- The agreement should be entered into well in advance of the wedding (normally a minimum of 21 days before the marriage).
- Provision should be made for any children.
Our family team can advise you on the merits of entering into such an agreement and can prepare the agreement on your behalf.
We can also advise with and prepare:
- Cohabitation Agreements
- Pre-Civil Partnership Agreements
- Post Nuptial Agreements (entered into after marriage)
These serve the same purpose as a Pre-Nuptial Agreement in that they formally record what will happen to your assets if your relationship were to come to an end. Again they are not automatically binding and the same criteria as detail above should be followed to give them the best chance of success.
At rhw we can draft and advise on these agreements for you. If these matters effect you please complete a contact form or call us directly on 01483 302 000 or email samantha.jago@www.rhw.co.uk
