Our commercial property solicitors handle a wide range of instructions relating to real estate, involving different types of property such as offices, shops, warehouses and industrial units:

Sale of freeholds and purchase of freeholds

All aspects of commercial leasehold work: this involves the negotiation of heads of terms and settlement of new leases, and lease renewals. It also includes work involving existing leases, for example sale and purchase of a lease.

We also handle investment work involving freeholds and leaseholds which can include sale and leaseback transactions.

Property management work:

This is legal work which is usually non-transactional, i.e. not related specifically to a sale or purchase or a lease, for example, licences from landlords to their tenants for alterations, assignment and underletting. There may also be issues about service charges. There may be discussions about whether a licence to occupy would be a suitable alternative to a lease.

Property disputes:

In conjunction with our Dispute Resolution Team we deal with issues arising relating to dilapidations, rent, rent arrears, the way in which rent reviews are interpreted or implemented, rights of way and boundary disputes.

Property finance:

We get involved in a range of security documents such as legal charges, mortgages and guarantees.

Options:

We deal with options to acquire property and rights of first refusal. These are sometimes related to the need to get planning permission and we are experienced in negotiating conditional agreements where the sale of land is conditional on getting such permission to enable a developer to proceed with a development.

The team also works closely with our Business and Commercial team, handling the property aspects of company share sale and purchase agreements or assets sales and purchases.
