Force Majeure clauses are in the spotlight currently. They have been fairly standard in most contracts for a long time. A common clause in that essentially frees both parties from liability or obligation when an extraordinary event or circumstance beyond the control of the parties, described by the legal term act of God, prevents one or both parties from fulfilling their obligations under the contract.
The present situation has shown how many of them are badly worded or were just not up to the job when an event like the present pandemic emerged. Now we understand the consequences of a tiny virus it’s about time we got our act together on future contractual obligations.
